Acceptable Usage Policy

To provide a professional and trustworthy service, we have established a set of clear guidelines for anyone using our infrastructure. Some of these guidelines may seem strict, but they exist to guarantee a safe, stable, and reputable environment for every customer on our network.

Many providers do not hold their customers to standards like these. If a prospective customer is unwilling or unable to comply with this policy, we respectfully suggest they look elsewhere.

Compliance with German & EU Law

Mediasecure operates under German and European Union law. It is a criminal offence under German law to access, alter, or sabotage computer data or systems without authorization (Sections 202a–303b of the German Criminal Code, Strafgesetzbuch), or to produce, possess, or distribute child sexual abuse material (Sections 184b–184c StGB). Customers may not use our services for any activity that violates these or related provisions, including harassment and stalking (Section 238 StGB) or incitement to hatred and violence (Section 130 StGB).

Infringing intellectual property rights — including copyright, patents, database rights, and registered trademarks — is likewise a criminal offence under the German Copyright Act (Urheberrechtsgesetz). Customers are reminded that sharing copyrighted material through peer-to-peer software without the rights holder's permission may constitute a criminal offence. Mediasecure will cooperate with any agency or rights holder seeking to assert their rights and reserves the right to suspend service where such infringement occurs.

The General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz) impose extensive duties on anyone processing personal data belonging to third parties. Customers who process such data for purposes beyond purely personal or household use are responsible for their own compliance with these obligations, including registration with the competent data protection authority where required.

Under the EU Digital Services Act and German digital services law, Mediasecure is, in general, not liable for unlawful acts carried out through our services unless we have actual knowledge of them. Where we become aware of credible evidence of unlawful activity, we will act promptly to bring it to an end.

Compliance with Foreign Law

The internet is global by nature, which means it is possible to breach the laws of other countries simply by using it. Customers are advised to take all reasonable steps to avoid violating any foreign law that may apply to their activity.

Prohibited Uses

Customers are responsible for all content hosted or transmitted through their account, including securing any necessary permissions for third-party works. Mediasecure reserves the right, without notice or explanation, to remove from the network any server or account that does not comply with this policy. The list below is illustrative, not exhaustive.

Unlawful Activities

• Unlawful gambling activities
• Threats, harassment, or abuse directed at any individual, organization, or business
• Fraudulent activities of any kind
• Content promoting terrorism, violence, or hatred based on religion, ethnicity, or national origin
• Unlawful high-yield investment schemes, Ponzi schemes, or advertising of such schemes

Child Sexual Abuse Material

Our services must never be used to publish, upload, download, store, or transmit child sexual abuse material in any form. Any account found engaged in this activity will be terminated immediately and reported to the competent law enforcement authorities without prior warning.

Hacking & Unauthorized Access

Using our services to gain, attempt to gain, or assist others in gaining unauthorized access to any host, network, server, device, or data — or to test the security of a system without the express authorization of its owner — is strictly prohibited.

Threatening or Harmful Content

Our services may not be used to host, transmit, or retransmit content that threatens the health or safety of others. Mediasecure reserves the right to decline service where content is obscene, hateful, malicious, defamatory, fraudulent, or otherwise harmful.

Intellectual Property Infringement

Publishing, transmitting, storing, or reproducing content that infringes the intellectual property or privacy rights of any party is prohibited, including violations of copyright, patent, trademark, or trade secret protections.

Malware Distribution

Storing, distributing, or deploying malware — including viruses, rootkits, password crackers, adware, or key-logging software — is prohibited, except where such tools are used in the ordinary course of legitimate security research or testing, and only with Mediasecure's prior, case-by-case approval.

Phishing

Any activity designed to collect personal or financial information under false pretences — including phishing pages, forms, or related email distribution — will result in immediate account suspension.

Denial of Service (DoS/DDoS)

Mediasecure strictly prohibits the use of our services to originate, propagate, or control denial-of-service or distributed denial-of-service attacks of any kind. Any involvement in such activity is a direct and immediate violation of this policy.

Zero-Tolerance Anti-Spam Policy

Important Notice

Any account whose activity causes a Mediasecure IP address to be listed on a spam database or blacklist will be terminated immediately, without prior warning.

Right to Refuse Service

Mediasecure reserves the right to refuse service to anyone, for any reason, in order to maintain a professional and trustworthy environment for everyone on our network.
